Use of the service
Budapest.fm provides a website together with podcast hosting, listing, and recording services. The content on our website is provided for informational and entertainment purposes. We grant you a non-exclusive, non-transferable, limited right to access and use the website and services in line with these Terms. You agree not to use the service for any unlawful purpose, to infringe the rights of others, or in any way that disrupts or damages the service.
Accounts and hosting
To host a podcast you need an account. You are responsible for the information you provide, for keeping your login details secure, and for all activity under your account. You must be at least 18 years old, or have the authority to accept these Terms on behalf of an organisation. We may suspend or close accounts that breach these Terms.
Fees, billing and renewals
- Plans and prices. Hosting plans and their prices are shown on our pricing page. Prices are displayed in your chosen currency (HUF, EUR, or USD) and include any applicable taxes where required.
- Payment. Payments are processed securely by Stripe. By subscribing you authorise us to charge your chosen payment method for the plan you select.
- Renewals. Subscriptions renew automatically at the end of each billing period (monthly or annual) until you cancel. We charge the then-current price for your plan on each renewal.
- Price changes. We may change plan prices. Any change applies from your next billing period, and we will give you reasonable notice beforehand.
Cancellation and refunds
You can cancel your subscription at any time from your billing portal. When you cancel, your plan stays active until the end of the current billing period, after which it will not renew. Except where required by law, payments already made are non-refundable. If you are a consumer in the EU, statutory withdrawal rights may apply where relevant.
Your content
You keep ownership of the podcasts, audio, artwork, and other material you upload or migrate to Budapest.fm (“Your Content”). By hosting with us, you grant Rayofla Kft. the right to store, reproduce, distribute, and publicly display Your Content as needed to operate the service, including delivering your episodes through RSS feeds and podcast directories. You are responsible for Your Content and confirm that you own it or have the necessary rights, and that it does not infringe any third party’s rights or any law. We may remove content that breaches these Terms or that we are legally required to remove.
The Open Door: public recordings
The Open Door lets anyone record a short spoken story in the browser and submit it to Budapest.fm, without an account. If you use it, the following terms apply to your recording.
- Eligibility. You must be at least 18 years old, or have permission from a parent or legal guardian, to submit a recording.
- Your recording and the licence you give us. You keep ownership of your recording. By submitting it, you grant Rayofla Kft. a worldwide, royalty-free, non-exclusive, sublicensable licence to edit, reproduce, distribute, publish, broadcast, and otherwise use the recording, in whole or in part, as part of Budapest.fm podcasts, our website, RSS feeds, podcast apps, social media, and promotional materials. This is a licence to use your recording; it is not a transfer of ownership.
- Your promises. By submitting, you confirm that: the recording is your own voice and you have the right to submit it; you have the consent of anyone else who can be heard or identified in it; it does not contain music or other material you do not have the rights to use; and it contains nothing unlawful, hateful, defamatory, or infringing.
- Editorial rights. Submitting a recording does not guarantee it will be published. We may edit, shorten, reject, or remove any submission at our sole discretion. We may edit a recording for clarity, length, or production quality without changing its intended meaning.
- Public release. You understand that, if published, your recording (and any first name or city you choose to give) may be made publicly available worldwide. Because episodes are distributed through RSS feeds and third-party apps, published audio may be copied, downloaded, cached, or redistributed by others, and we may not be able to retract copies once they have been distributed.
- AI-assisted production. We may use AI-assisted tools for tasks such as transcription, translation, noise reduction, audio enhancement, moderation, tagging, or summarisation.
- Guidelines. Please follow our Recording Guidelines when you record.
- Removing a recording. You can ask us to remove your recording at any time by emailing hello@budapest.fm. We will delete a recording that has not been published. For a recording that has already been published, we will remove it from our website and future distributions, but we may not be able to retract copies already downloaded or cached by podcast apps.
Guest and contributor submissions
If you take part in a show as a guest or contributor, or send us text, audio, images, a biography, links, topic ideas, comments, or other material, you confirm that you have the right to submit it, that it is accurate to the best of your knowledge, and that it does not infringe anyone’s rights or contain unlawful, defamatory, or harmful content.
By submitting such material, you grant Rayofla Kft. a worldwide, royalty-free, non-exclusive, sublicensable licence to use, edit, reproduce, publish, distribute, display, promote, archive, and adapt it in connection with Budapest.fm and its shows, feeds, platforms, newsletters, and social channels. Where a separate guest release or production agreement applies, that agreement controls where it conflicts with these Terms.
Editorial content
Budapest.fm publishes independent editorial and podcast content. Opinions expressed by hosts, guests, contributors, or interviewees are their own and do not necessarily represent the views of Budapest.fm. Podcast content is provided for general information and entertainment. It is not legal, financial, medical, or other professional advice.
AI-assisted production
We may use editing, transcription, translation, restoration, voice-processing, or AI-assisted tools where appropriate and lawful, and we identify AI-voiced or AI-assisted episodes where the show format requires it. You must not submit another person’s voice, likeness, image, or copyrighted material unless you have the rights and permissions needed for the intended use.
Podcast feeds and sharing
We publish RSS feeds so listeners can subscribe through podcast apps. You may subscribe to, link to, and share those feeds in the normal way. You may not use our feeds to impersonate Budapest.fm, create confusing duplicate shows, strip attribution, insert your own advertising, sell access to our free content, or redistribute content in a way that misleads listeners or infringes rights.
Third-party platforms
Budapest.fm links to and embeds third-party services such as Apple Podcasts, Spotify, YouTube, podcast apps, social networks, and payment providers. We do not control these services and are not responsible for their content, availability, policies, or data practices. Your use of them is governed by their own terms and privacy policies.
Intellectual property
All content, software, and materials on Budapest.fm that are not Your Content, including text, graphics, logos, and design, are the property of Rayofla Kft. or its licensors and are protected by Hungarian and international copyright and trademark laws. You may not republish, sell, reproduce, or redistribute our materials without our prior written consent.
Availability of the service
We aim to keep Budapest.fm available and reliable, but we do not guarantee uninterrupted access, error-free operation, or the permanent availability of any episode, feed, page, or listing. We may update, move, edit, remove, redirect, archive, or discontinue content, features, feeds, or services at any time.
Disclaimers and limitation of liability
- Accuracy. While we work to keep Budapest.fm accurate and available, we provide it “as is” and “as available” and do not warrant that it is complete, accurate, or uninterrupted.
- Liability. To the fullest extent permitted by law, Rayofla Kft. will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, data, or goodwill, arising from your use of, or inability to use, the website or service.
- Cap. To the fullest extent permitted by law, our total liability for any claim relating to the website or services is limited to the amount you paid us for the service giving rise to the claim in the three months before the claim arose, or EUR 100 if you made no payment.
- Mandatory rights. Nothing in these Terms limits any liability that cannot legally be limited or excluded.
Indemnity
You agree to indemnify and hold harmless Rayofla Kft. and its team from claims, losses, liabilities, costs, and expenses arising from your use of the service, your submissions or recordings, your breach of these Terms, or your infringement of another person’s rights.
Privacy
Your use of Budapest.fm is also governed by our Privacy Policy, which explains how we handle your personal data.
Changes to these terms
We may modify these Terms from time to time. When we do, we will update the “Last updated” date above. Your continued use of Budapest.fm after changes take effect means you accept the updated Terms.
Governing law and disputes
These Terms are governed by the laws of Hungary, without regard to conflict-of-law rules, and without prejudice to any mandatory consumer protections in your country of residence. The courts of Hungary have jurisdiction over any dispute. Before bringing a formal claim, please contact us at hello@budapest.fm so we can try to resolve the issue informally.
